Safeguarding your personal information is of utmost important to BandPay.ME, LLC, (“BandPay”). We are committed to preserving your privacy. Our Policy applies to all information collected from users as a result of the use of any products, services, content, features, technologies, functions, applications and services (collectively the “Services”) offered by BandPay. When you are no longer a BandPay customer, we may continue to share your information as described in this Policy. In order to use our Services, you must agree to our collection of this information. As used herein, the term “personal information” is used to describe information that can be linked to a particular person and can be used to identify that particular person. Information is not considered personal if it does not clearly identify a specific individual or user.
In order for BandPay to complete your transaction, we necessarily need to share some of your personal information with the person or company that you are paying or is paying you, as well as with Stripe, BandPay’s online payment processor (www.stripe.com). With the exception of Stripe, or any other online payment process that BandPay may subsequently engage, BandPay will not disclose your credit card or bank account numbers to anyone you have paid or who has paid you through BandPay, without your express permission unless required by law. In that Stripe will process your transaction, Stripe’s privacy policy policies, as well as Stripe’s terms and conditions, will govern parts of the transaction. We encourage you to familiarize yourself with Stripe’s policies.
BandPay may update this Policy at any time and if any material changes are made in the way your personal information is used, stored or shared, we will post any revisions to our website. It is your responsibility to periodically review our Policy as all of BandPay’s users are bound by any subsequent changes or modifications.
BandPay is committed to providing safe and secure Services. Therefore, before permitting you to use the Services, we require information to verify your identity, and may obtain information about you from third parties for verification, fraud prevention, and related purposes. Finally, BandPay does not intend that its Services are to be utilized by individuals under the age of eighteen (18). If we obtain actual knowledge that we have collected personal information from a child under the age of eighteen (18), we will promptly delete it, unless legally obligated to retain such data.
Personal information is collected and used first and foremost to provide secure Services. Your personal information is used to, among other things: process transactions, send notices about your transactions, provide customer support, assist in resolving disputes, collect fees, troubleshoot problems, prevent fraudulent or illegal activities, and create a financial connection between you and select third-parties. Additionally, we may also use this information to send you updates and notices, improve and customize our services, and other reasons required by law. You can log in to your account at any time to review and update your personal information.
To effectuate transactions, BandPay may need to share some of your personal information with the other transacting party, as well as BandPay’s payment processor and third-party vendors. BandPay’s third-party vendors may also share information about you with us. This information may be used to confirm your customer status and transaction history.
Some personal information is public information, including your BandPay username, profile photo, listed name, and public transactions in which you have been involved. BandPay does not share your non-public personal information with third parties for its promotional or marketing purposes. BandPay may, however, share your personal information with any of BandPay’s subsidiaries, affiliates, parent company, or bankruptcy estate (if applicable), or companies that plan to merge with or be acquired by BandPay, for the purposes allowed in this Policy. Your personal information will also be shared with Stripe and other third party service providers who assist us in providing services to you and/or who provide services integral to BandPay’s business operations, or provide fraud detection or similar services on our or any vendor’s behalf. Additionally, if you authorize or consent to an account connection with a third-party, personal information may be shared in order to properly conduct the transaction.
Further, BandPay will comply with any law enforcement or government request, subpoena, court order or similar legal procedure, when required by law. BandPay will also provide the disclosure of personal information when reasonably necessary to prevent suspected physical or financial harm, or illegal activity.
Your personal information is stored and retrieved using third party servers located in data centers within the United States. This information is protected by layers of procedural safeguards, including physical and electronic safeguards placed in compliance with applicable Federal and state regulations. Additional measures such as firewalls, data encryption, and physical access controls are in place to prevent unauthorized access to personal information.
Unfortunately, despite these safeguards and our best efforts, BandPay cannot guarantee that personal information will not be accessed, disclosed, manipulated, altered or destroyed. Therefore, you are strongly encouraged to take precautions to protect your information, including but not limited to securing your BandPay password. If we are alerted to a system security breach, we may notify you electronically, post a notice on our website or mobile application or, depending on where you live, you may receive written notice of the breach. BandPay may provide links to third-party services or websites. Be aware, BandPay does not control the information collected by such third-party services or websites.
When you visit or use our Services or visit a third-party website for which we provide online services, BandPay and its business partners and vendors may use cookies and other tracking technologies (collectively, “Cookies”). Cookies are used to recognize you as a customer; customize Services, content and BandPay’s advertising; measure the effectiveness of promotions; perform a wide range of analytics; prevent potential fraud; and to ensure the safety of our Services.
Certain Services are only available with the permitted use of Cookies. Consequently, if you disable or decline to allow Cookies, certain Services may be limited or unavailable to you.
If your BandPay account has either a California or Vermont mailing address, BandPay will not share the personal information that it has collected about with except to the extent permitted under these states’ respective laws.
